Dynamite responds to ERB Inc. lawsuit over John Carter, Tarzan

In response to the lawsuit filed in February by Edgar Rice Burroughs Inc., Dynamit has filed what amounts to a blanket denial to accusations of trademark and copyright infringement and unfair competition involving its Lord of the Jungle and Warlord of Mars comics.
ERB Inc., which holds the existing rights to the works of the author of Tarzan and John Carter of Mars, claims the comics Lord of the Jungle, Warlord of Mars, Warlord of Mars: Dejah Thoris and Warlord of Mars: Fall of Barsoom are likely to "deceive, mislead and confuse the public" about the source or sponsorship of the content, causing "irreparable injury" to the family-owned company. It also insists the titles were published without authorization after Dynamite Entertainment President Nick Barrucci was told that Dark Horse held the licenses for the Tarzan and John Carter of Mars books.
In its answer to the complaint, filed last week in federal court in New York City and first reported by The Beat, Dynamite points out that the Burroughs works on which the comics are based are no longer protected by U.S. copyright law. As to the trademarks, the publisher notes, "There are numerous examples of Burroughs’ novels, and other works inspired by Burroughs’ novels bearing such alleged marks or similar marks, which have been published by third parties without any reference to" ERB Inc.
"In addition, Burroughs’ public domain novel Tarzan of the Apes has been republished by numerous publishers without any attribution to plaintiff, and the basic story of a jungle-dwelling, Tarzan-like character has appeared in and film without any affiliation to plaintiff," the document states.
Dynamite, of course, asks the court to dismiss the lawsuit, which will likely be watched closely by those concerned with what’s been characterized as an effort to use a trademark to, effectively, prolong the duration of copyright.

Indie Creators Headline Marvel's Mars

Two Indy comics creators have been tapped to chronicle the further adventures of John Carter's Mars for Marvel Comics. John Carter: The Gods Of Mars is the publisher's latest collaborative project with the Edgar Rice Burroughs estate.
Sam Humphries, writer of the self-published comics Our Love is Real and Sacrifice is teamed withwith artist Ramón Pérez, the illustrator of Archaia's hardcover graphic novel Jim Henson's Tale of Sand.
John Carter: The Gods Of Mars is based on the 1918 Burroughs novel and is slated for five issues debuting March 2012, the same month John Carter, a live-action feature film from Marvel parent company, Disney, is scheduled for release. Currently, Marvel has two John Carter miniseries running; John Carter: World of Mars and John Carter: A Princess of Mars.
"From Landridge and Andrade to Edgar Rice Burroughs himself, there's an impressive foundation of awesome John Carter stories to build on," Humphries said in Marvel's press release. "Combined with Marvel having the most exciting comics going on right now, and most talented editors in the industry — I can't wait to get myself to Mars."

DISNEY RELEASES JOHN CARTER OF MARS TRAILER
Based on the Edgar Rice Burroughs Barsoom novels, the full-length trailer for Disney's John Carter of Mars movie has been released.
John Carter of Mars is inexplicably transported to the mysterious and exotic planet Mars, and becomes embroiled in a conflict of epic proportions and discovers that the survival of the planet and its people rests in his hands.
John Carter is a sweeping action-adventure set on the mysterious and exotic planet of Barsoom (Mars). John Carter is based on a classic novel by Edgar Rice Burroughs, the creator of Tarzan, whose highly imaginative adventures served as inspiration for many filmmakers, both past and present. The film tells the story of war-weary, former military captain John Carter (Taylor Kitsch), who is inexplicably transported to Mars where he becomes reluctantly embroiled in a conflict of epic proportions amongst the inhabitants of the planet, including Tars Tarkas (Willem Dafoe) and the captivating Princess Dejah Thoris (Lynn Collins). Princess of Mars is an Edgar Rice Burroughs science fiction novel, the first of his famous series, which initially began publication in serialized form within the pages of All-Story Magazine in February 1912. It is also Burroughs' first novel, predating his Tarzan stories. Full of swordplay and daring feats, the story is considered a classic example of 20th century pulp fiction.
Edwin Lester Arnold's Gullivar of Mars novel, originally published as Lieutenant Gullivar Jones: His Vacation in 1905, bears a number of striking similarities to Burroughs' Princess of Mars. Both Gullivar and Burroughs' protagonist John Carter are Southern United States soldiers who arrive on Mars by apparently magical means (magic carpet in the case of the former, astral projection in that of the latter) and have numerous adventures there, including falling in love with Martian princesses. Gullivar is a more hapless character, however, paling beside the heroic and accomplished Carter. Gullivar, in contrast, stumbles in and out of trouble and never quite succeeds in mastering it.
Robert Napton has written hundreds of comics. He is currently writing WARLORD OF MARS: THE FALL OF BARSOOM for DYNAMITE. In 2008, he adapted Terry Brooks' DARK WRAITH OF SHANNARA as a graphic novel and wrote the new BATTLESTAR GALACTICA.
